Two years — but the government clock is far shorter
Idaho gives most personal injury and wrongful death lawsuits two years from the date of injury or death (Idaho Code 5-219). But if a government entity is involved — a city vehicle, a transit bus, a state road defect — the Idaho Tort Claims Act requires a written notice of claim within 180 days (6-906), and that deadline is jurisdictional: miss it and the claim is generally gone, no matter how strong. Waiting is costly either way — witnesses scatter and video gets erased.
The 50% bar: modified comparative negligence
Idaho follows modified comparative negligence (6-801): you can recover as long as your share of fault is less than the other party's — recovery is barred once your fault is as great as theirs — with any award reduced by your percentage. It's exactly why insurers push so hard to shift blame onto you.
Dogs and motorcycles
Idaho's dog-bite law is negligence-based, not automatic strict liability: an owner is liable when they knew or should have known the dog was dangerous, or broke a leash law. For riders, lane splitting, filtering, and sharing a lane with a car are all illegal in Idaho — only two motorcycles may share a single lane. A rider between lanes can be cited, though a driver who caused a crash can still be responsible.
Reporting a crash — and no Level I trauma
Idaho requires immediate notice to police for a crash involving injury, death, or property damage over $1,500 (49-1305). And a fact worth knowing: Idaho has no Level I trauma center — the most severe injuries are often stabilized locally and transferred out of state, which can complicate care and costs.
