Washington Car Accident Laws, in Plain English

Three years to file, fault that never fully bars you, a government-claim waiting period, and one of the nation's strictest dog-bite laws — Washington's rules, without the legalese.

Three years to file — usually

Washington allows three years from the date of injury to file a personal injury lawsuit (RCW 4.16.080). But claims against a government entity — a transit bus, a city vehicle, a state road defect — require presenting a formal claim first and waiting 60 days before filing suit (RCW 4.96.020). When anything public is involved, the procedure is as important as the deadline.

Pure comparative fault: partial blame never bars you

Washington follows pure comparative negligence (RCW 4.22.005): you can recover even if you were mostly at fault, with your recovery reduced by your share. There is no 50% or 51% cutoff — which changes how insurers negotiate, and why 'it was partly my fault' is never the end of the story here.

Rain, passes, and the crashes they cause

Washington driving has its own physics: nine months of wet pavement, black ice on the mountain passes, and some of the nation's densest commuter corridors on Interstate 5. Fault analysis in these crashes often turns on speed for conditions — drivers must adjust to the weather, and 'I hydroplaned' is rarely a defense. Start at the Washington car accident hub.

Dogs, lane splitting, and the first offer

Washington has one of the strictest dog-bite laws in the country: owners are strictly liable for bites regardless of the dog's history (RCW 16.08.040). Lane splitting is not legal for motorcyclists. And on any claim: first offers often arrive before the damage is fully known — a participating Washington law firm can review an offer for free at the Washington personal injury hub.
